GRANT OF NFGP AT LEVEL 10


There is only one comment on below posting which is about Grant of GP of Rs.5400/- on completion of 4 years in GP of Rs. 4800/- earned under MACP by ASPOs prior to 1-1-2012 but promoted or joined in Group B after 1-1-2006 and prior to 1-1-2016. Our demand is that all such Group B officers should be granted non functional Grade Pay of 5400/- from the date they have completed 4 years regular service in Grade Pay of 4800/- as also allowed to similar placed officer of CBDT/CBEC and other department on the basis of Hon’ble CAT judgement. Whereas no benefit of higher responsibility whatsoever was given on joining the Group B on regular basis. However NFGP of 5400/- was granted only after four years of Group B service and now this benefit is also not being given. This is the case for officers who completed four years service prior to 1-1-2016 only. Please do not link it with NFGP after 1-1-2016.
The tweet of my learned friend is that we can demand NFGP to GP of Rs. 5400 in PB-3 (level 10) after completion of 4 yrs regular service in SPO cadre. Yes why not and this is our demand too. Actually prior to implementation of 7th CPC Group B officers were given GP Rs 5400/- after completion of 4 years of service in PS Group B. Consequently many our members were getting pay fixture under 2nd and 3rd MACP to that level on personal basis without actual promotion. There was only charm of getting fixture after four years of service on joining Group ‘B’ under non functional GP of 5400/- but unfortunately this fixture has also been withdrawn by the department while placing Group ‘B’ officer at next level on completion of 4 years of service in Group B on implementation of 7th pay commission. Consequent upon implementation of 7th pay commission simple replacement at level 9 has been given that without benefit of fixture as provided in illustration. Now Ministry of Finance vide F No. 26017/219/2016- Ad.II.A dated 10-4-2017 copy of which is pasted below had clarified to the revenue department that under 7th CPC recommendation only normal replacement pay level for Superintendents has been allowed so NFGP introduced on the basis of 6th CPC recommendation will continue under 7th CPC regime by replacing the pay structure of pay band and Grade Pay with the corresponding Pay Levels/ Cells in Pay Matrix. All other department has implemented these orders by fixing the pay on promotion as given in Rule 13 of CCS Revised Pay Rules 2016. Our department is silent on this texture. As such Ministry of Finance vide F No. 26017/219/2016- Ad.II.A dated 10-4-2017 should be circulated to all circles with instructions to fix pay of all PS Group B officers on completion of four years of service in Group ‘B’ with corresponding pay levels/cells in Pay Matrix i.e from level 9 to 10. In case these orders are not implemented by our department then we will take legal remedy and it will be our second CAT case to file.


Benefit of GP of Rs.5400/- on completion of four years in GP of 4800/-


Please go through these Ministry of Defence letter no. L-373/US(MM) D(N-11)/17 dated 8-2-18 and Ministry of Information and Broadcasting vide letter no F. No.515/63/2016-BA(E) vide which benefit of Grade pay of Rs. 5400/- in PB-II on non functional basis after completing 4 years of regular service in the grade pay of Rs.4800/- in PB-II has been extended to all similar placed officers in their department after having approval of Department of Expenditure, MOF as conveyed vide UO NO. 22(4)/E.III.B dated 10.11.2017. Our department is not extending the benefit to similar placed officers. We have decided to take legal remedy for our officers. Please comment what should our course of action in this regard as It will require funds to file case.



Fixture of pay of Group ‘B’ officers w.e.f. 1-1-2006 while issuing orders for placing IPs in GP of Rs. 4600/-
Our association has raised this issue with directorate, as per representation posted on this blog also for which file is under submission and decision is likely to be received within one month. All are requested to kindly peruse these letters.
It is hoped that:
1. As provided in MOF OM No. 10/2/2011.E.III/A dated 7-1-2013 fixture of pay in ASP cadre will be done in the manner as prescribed in Rule 13 (i) of CCS (RP) rules 2008 w.e.f 1-1-2006, thereby means addition of one increment for those who were ASPs as on 1-1-2006.
2.  In view of para 7.6.14 of the report of 6th Pay commission  Group “B” officer in PB-2 with a Grade pay of Rs. 4800/- will get the Grade Pay of Rs. 5400/- after completing 4 years of regular service   on non – functional basis even if received under MACP. It is our demand also that it should not linked to joining in Group ‘B’. A positive note is there in the file so most probably decision will be in our favour. In case 1% decision is received against us then be prepared to file a case in CAT bench Chandigarh. This benefit will not be application to those who got GP of Rs. 4800/- after 1-1-2012 because as on 1-1-2016, 7th pay commission upgraded the scale of IP/ASP/Group B to 4600/4800/5400 and our pay has been fixed accordingly w.e.f 1-1-2016 and in such event revised pay rules will be applicable.
