Consumer Price Index for Industrial Workers (CPI-IW) – March, 2019

The All-India CPI-IW for March, 2019 increased by 2 points and pegged at 309 (three hundred and nine). On 1-month percentage change, it increased by (+) 0.65 per cent between February, 2019 and March, 2019 which was static between the same two months a year back.

The maximum upward pressure in current index came from Food group contributing (+) 1.53 percentage points to the total change. At item level, Arhar Dal, Goat Meat, Chillies Green, Apple, Coconut, Lemon, Bitter Gourd, Brinjal, Cabbage, Carrot, Cauliflower, French Bean, Gourd, Lady’s Finger, Methi, Palak, Parval, Peas, Potato, Pumpkin, Radish, Tomato, Petrol, etc. are responsible for the increase in index. However, this increase was checked by Rice, Wheat, Wheat Atta, Coconut Oil, Mustard Oil, Fish Fresh, Eggs (Hen), Onion, Tamarind, Banana, Gowar Phali, Watermelon, Electricity Charges, Flowers/Flower Garlands, etc., putting downward pressure on the index.

The year-on-year inflation based on CPI-IW stood at 7.67 per cent for March, 2019 as compared to 6.97 per cent for the previous month and 4.36 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at (+) 3.96 per cent against (+) 2.63 per cent of the previous month and (+) 1.68 per cent during the corresponding month of the previous year.

At centre level Munger-Jamalpur and Lucknow reported the maximum increase of 6 points each followed by Kanpur, Bhilwara and Ranchi-Hatia (5 points each). Among others, 4 points increase was observed in 3 centres, 3 points in 10 centres, 2 points in 17 centres and 1 point in 19 centres. On the contrary, Kodarma recorded a maximum decrease of 5 points followed by Tiruchirapally (3 points) and Chennai (2 points). Among others, 1 point decrease was observed in 8 centres. Rest of the 13 centres’ indices remained stationary.

The indices of 33 centres are above All-India Index and 44 centres’ indices are below national average. The index of Rourkela centre remained at par with All-India Index.

The next issue of CPI-IW for the month of April, 2019 will be released on Friday, 31st May, 2019. The same will also be available on the office website www.labourbureaunew.gov.in.

Sir,
have been directed to refer to the subject cited above and to state that the Hon’bIe Madras High Court vide its judgment dated 15.9.2017 in CWP No. 15732 of 2017-P. Ayyamperumal Vs. Union of India had allowed an Annual Increment on notional basis for the purpose Of pensionary benefits to the petitioner on I .7.2013 who had otherwise retired on 30.52013. The rationale of the judgment was that the Increment has to be granted On completion On full year or service and s:nce the employee concerned had retired on 30.69013 after the fun length of service of one year from 1 .7.2012 to 30.6.2013 he was allowed the Annual Increment as on 1.7.2013 on notional basis for the oi pensionary benefit*. This judgment was later on upheld in the Hon’ble Supreme Court in SLP No. 22283 of 2018- Union of India Vs. p. Ayyamperumal, decided on 23.7.2018.
A number of cases on the same lines are being received comprising administrative proposals, judgments from the Hon’ble Punjab & Haryana High Court delivered in terms of judgment of Hon’ble Supreme Court ibid. Further, a number of CWPs, Representations from retired Employees and certain Legal Notices have also been received and have pouring in regularly relying upon the judgment Of Hon’ble Supreme Court ibid.
In view Of the above the matter was considered meticulously weighing all possible pros and cones and since the judgment or Hon’ble Supreme Court ibid has been delivered a case where Central Govt was party, the Central Govt. has, therefore, been requested vide this Department Ietter dated 28.3.9019 to apprise or the latest position in this respect to the Haryana Govt. so that appropriate policy decision may be taken accordingly. This request has been sent to Central Govt. since the remedy Of Review
Application and Curative Petition still subsists with it end it would be in the fitness of things that a decision by the Haryana Govt. may be taken Only after ascertainment of final decision from the Govt. of india. A copy of request dated 28.3.201′ sent to Central Govt. is attached herein.
In view of the above it is requested that all of the pending cases i.e. CWPs/Court Cases, Representations, Legal Notices on the instant subject may be dealt with/disposed of accordingly. In the decided cases where in a direction has been issued by the Hon’ble High Court/ I-d. Courts to decide the Representations/ Legal Notices of the petitioners LEC Petitioners/ Counsel of Petitioners may be informed accordingly. Likewise, adjournment may he requested in the cases Where Reply is to be fled. ‘The under consideration Representations/ Legal Notices may also be disposed Of in the same terms informing the factual position to the Employees (Counsels concerned. The next line of action be informed in due course.

Respected Sir,
I am directed to refer to the subject cited above and to state that The Haryana Govt. has broadly followed the pattern Oi Central Govt. in Pay and Pension Structure while its Pay pension Rules pursuant. To recommendations of Central Pay Commissions. the Pay Rule of 2006 there was a uniform date or grant or Annual Increment being of July of eve-or calendar month Whereas in the 2015 Rules there are two dazes being Of January and of July depending upon the circumstances. The minimum length of service Lo earn the Annual Increment is uniform In of the Rules i.e. six months of qualfying service.
Some of the retired Officers/ Employees brought to the notice of this Department a judgment dated 25-9.2017 (Copy Attached) of DB Of Hon’ble Madras High Court delivered in CWP No. 15732 of 2017- P. Ayyamperumal Vs. Union India wherein the Hon tile Madras High Court has allowed the benefit of Annual increment, on notional basis to the petitioner who retired on 30.6.2013 for Pensionary benefits only for the period of I. 7.2012 to 30-62013 though the Increment [ell due on The Operative part of the judgment ibid is reproduced herein below for your ready reference;-
The petitioner herein had completed one full year service as on 30.6.2013, but the increment feu due on 1.7.2013, on which date he was not in service. In view of the above judgment of this Court, naturally he has to be treated as having completed one year of service though the date of increment fans on the next day of his Applying the said judgment to the present case, the writ petition Es allowed and the impugned order passed by the first respondent-Tribunal dated 21.3.2017 is quashed. The petitioner shall be given one notiona: increment for the period from 7.7.2012to 30.6.2013, as he has completed one fun year of service, though his increment fell on 01.07.2013, for the purpose of pensionary benefits and not for any other purpose. No Costs.
This judgment was later on upheld by the Hon’ble Supreme Court Of India vide its judgment dated 23.7.2018 (Copy Attached) in SLP NO. 22283 Of 2018 and the inference comes out is that this issue has attained finality until and unless it has been challenged further by the Govt. of India by means Review Application/ Curative Petition, if any.
In view of the legal position as above, the Hon’ble Punjab & Haryana High Court has disposed of number of cases is The same terms against the State of Haryana wherein the retired employees of the Haryana Govt. had demanded similar benefit being affinity Of Rules. Besides, a. number of CWPs/Court Cases are also sub judice in the Hon’ble High Court and the Haryana Govt is not able to file proper reply therein in view of the judgment Of Hon’ble Supreme Court ibid. Further, number Of Legal Notices arc also pending and lot more arc also In on regular intervals from the relired employees demanding same benefits and a warning of filing of Court Case in the cage Of denial thereof is also being conveyed
As such: it is kindly requested that the factual position may Se clarified conspicuously as per points mentioned below
1.As to whether the Govt. of India has further challenged the Aforesaid judgment in SLP by way of RA/Curative Petition and if yes the detail thereof may please be conveyed.
2.If the action to challenge has not been materialized then as to whether it is under consideration.
3.As to whether the same has been implemented and if yes, the copy of relevant Rule/lnstruction/ Order may please be provided
4.It may please be clarified, in case this judgment has been implemented as to whether the Increment is countable for Pension purpose exclusively or for other retiral benefit i.e. Communication of Pension, DQÜ and Leave Encashment etc.
5.Though the judgment ibid has been delivered keeping in view the Pay Rules 2006 wherein only single date of Annual Increment i.e. 1st July of every calendar year was provided whereas With the commencement or 2016 Rules [here have been provided two dates of Increments i.e. 1st of January and 1st July. It may, therefore, please he clarified RS to whether it would also apply to Govt. employees retiring after 01.01-2016.
6.As to whether the Govt- of India has accordingly amended or contemplating to amend its Pay and Pension Rules (please clarify conspicuously) to make them compatibIe in view of the factual position as such.
The aforesaid information/ documents may please be provided at the earliest so that the Haryana Govt. may take appropriate decision in all the pending cases accordingly and no awkward position is faced in the Hon’ble High Court/other Ld. Courts.
If this issue does not relate to this Department/ Division then this communication may please refereed transferred to the Department/ Division concerned under intimation to this Department so as to enable it to follow-up the same accordingly With the authority concerned.

What are all the regulations for Central Government Employees seeking Employment else where ? How applications for Central Government Employees routed through present Administration are to be forwarded ?

1. Whether Administration can forward application of Government Employee seeks employment elsewhere?

There is no hard and fast rules laid down for forwarding of application of a Government servant for employment elsewhere. It is expected to every Government servant who has been offered a substantive post or appointment to a regular service in the Government and willingly accepted to devote his energies whole heartedly to the performance of his duties in that post and not to divert his attention in search for employment elsewhere.
However some guidelines has been framed for forwarding of applications of Government servants as direct recruit for posts within the Central Government, State Governments, Autonomous/ Statutory Bodies, Central Public Sector Enterprises etc. It may be noted that in a case in which a particular employee cannot be spared without serious detriment to important work in hand, public interest would justify withholding of his application even if otherwise the application would have been forwarded. It may be added for information that where for good and sufficient reasons an application is withheld no infringement of any Constitutional right is involved.

2. Interpretation of the Term Public Interest:

a. The Heads of Departments should interpret the term ‘public interest’ strictly and subject to that consideration, the forwarding of applications should be the rule rather than an exception. Ordinarily, every employee (whether scientific and technical or non-scientific and non-technical personnel) should be permitted to apply for an outside post even though he may be holding a permanent post.
b. No distinction need be made between applications made for posts in a Department under the Central Government, Autonomous Bodies or sub-ordinate offices, posts under the State Governments, posts in Public Sector Undertakings owned wholly or partly by the Central Government or a State Government and posts in quasi-Government organizations. They should all be treated alike so far as the forwarding of applications is concerned. If, however, a Government servant desires to apply for a post in a private concern, he should submit his resignation or notice of retirement, as the case may be, before applying for private employment.
c. For this purpose, “scientific and technical personnel”, may be interpreted to mean persons holding posts or belonging to services which have been declared to be scientific or technical posts or scientific or technical service.

3. Dealing of Applications for Employment Elsewhere

The general practice/ principles to be observed in dealing with such applications are as follows:
Applications from purely temporary Government servants
Applications from such Government servants should be readily forwarded unless there are compelling grounds of public interest for withholding them.
Applications from permanent Government servants
Both permanent non-scientific and non-technical employees as well as permanent scientific and technical employees could be given four opportunities in a year to apply for outside posts, except where withholding of any application is considered by the competent authority to be justified in the public interest.
Applications of Government servants who have been given some technical training at Government expenses after commencement of service
Such Government servant cannot justifiably complain of hardship if he is not allowed to capitalize the special qualifications so gained by seeking other better employment. Withholding of application in such a case is therefore justifiable.
Applications of Government servants belonging to Scheduled Castes and Scheduled Tribes, other than scientific and technical personnel
Applications for employment of temporary or permanent Central Government servants belonging to Scheduled Castes and Scheduled Tribes should be readily forwarded except in very rare cases where there may be compelling grounds of public interest for withholding such application. The withholding of application should be the exception rather than the rule in the case of employees belonging to Scheduled Castes and Scheduled Tribes who should be afforded every facility to improve their prospects.
Applications of Government servants belonging to Person with Disabilities other than scientific and technical personnel
Applications for employment of Government servants suffering from disability in terms of the provisions of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act, 1995 shall be readily forwarded except in very rare cases where there may be compelling grounds of public interest for withholding such application.
Application of Government servants for employment in private business and industrial firm, etc.
Where a Government servant (including a temporary Government servant) seeks permission, to apply for such employment, he should submit his resignation or notice of retirement, as the case may be, before applying for private employment. He cannot complain of hardship if his application is withheld. While a person remains in Government service, the state can legitimately refuse to surrender its claim on his services in favour of a private employer

4. Procedure to be followed for dealing with such applications

a) Applications from Government servants for employment elsewhere, submitted otherwise than in response to advertisement or circulars inviting applications, should not be forwarded.
b) The applications may be forwarded in accordance with the general practice/ principles given in above paragraph 1.3, irrespective of whether the “post applied for in the other department/ office is permanent or temporary”.
c) As for temporary Government servants they should, as a matter of rule, be asked
to resign from the parent department/ office at the time of release from the parent department/ office. An undertaking to the effect that he/ she will resign from the parent department/ office in the event of his/her selection and appointment to the post applied for may be taken from his/her at the time of forwarding the application. This procedure is to be followed even in case of a temporary Government servant applying as a direct recruit for a post in the same organisation.

d) In the case of permanent Government servants, their lien may be retained in the parent department/ office for a period of two years in case of the new post being in the Central/ State Government. They should either revert to the parent department/ office within that period or resign from the parent department/ office at the end of that period. An undertaking to abide by these conditions may be taken from them at the time of forwarding the applications to other departments/ office. In exceptional cases where it would take some time for the other department/ office to confirm such Government servants due to the delay in converting temporary posts into permanent ones, or due to some other administrative reasons, the permanent Government servants may be permitted to retain their lien in the parent department/ office for one more year. While granting such permission, a fresh undertaking similar to the one indicated above may be taken from the permanent Government servants by the parent department.
e) Permanent Government servants on their being selected for appointment in an Autonomous Body/ Central Public Sector Enterprises will have to resign before they are permitted to join the new organization. In their case, no lien shall be retained and they will be governed by the orders issued by Department of Pensions & Pensioners’ Welfare regulating mobility of personnel between Central Govt. and Autonomous Bodies/ Central Public Sector Enterprises etc.
f) The terms of the bond need not be enforced in the cases of those who apply for appointment elsewhere, other than private employment, through proper channel. However, the obligations under the bond would be carried forward to the new employment. An undertaking to this effect may be obtained from the Govt. servant before he is relieved.

5. Applications invited by UPSC / SSC

a) Where Government servants apply directly to UPSC/SSC as in the case of direct recruit, they must immediately inform the Head of their Office/Department giving details of the examination/ post for which they have applied, requesting him to communicate his permission to the Commission directly. If, however, the Head of the Office/Department considers it necessary to withhold the requisite permission, he should inform the Commission accordingly within thirty days of the date of closing for receipt of applications. In case any situation mentioned in para 1.6 below is existing, the requisite permission should not be granted and UPSC/SSC should be immediately informed of this fact as also the nature of allegations against the Government servant. It should also be made clear that in the event of actual selection of Government servant, he would not be relieved for taking up the appointment, if the charge-sheet/ prosecution sanction is issued or a charge-sheet is filed in a court for criminal prosecution, or if the Government servant is placed under suspension.
b) It may be noted that in case of direct recruitment by selection, i.e., “selection by interview”, it is the responsibility of the requisitioning Ministry /Department to bring to the notice of the Commission any point regarding unsuitability of the candidate (Government servant) from the vigilance angle and that the appropriate stage for doing so would be the consultation at the time of preliminary scrutiny, i.e., when the case is referred by the Commission to the Ministry /Departments for the comments of the Ministry’s representatives on the provisional selection of the candidate for interview by the Commission.
c) When once the Administrative Authority has forwarded an application, it is mandatory that the Government employee concerned should be released to take up the new appointment. However, where subsequent to the forwarding of the application, but before selection if exceptional circumstances arise in which it may not be possible to release the official, the fact should be communicated to the Commission as well as to the official concerned. The decision not to release an official should be taken only where the circumstances referred to above are really exceptional.

6. Circumstances in which Application should not be forwarded

Application of a Government servant for appointment, whether by direct recruitment, transfer on deputation or transfer, to any other post should not be considered/ forwarded, if
(a)
(i) he is under suspension; or
(ii) disciplinary proceedings are pending against him and a charge sheet has been issued; or
(iii) sanction for prosecution, where necessary has been accorded by the competent
authority; or

(iv) where a prosecution sanction is not necessary, a charge-sheet has been filed in a Court of law against him for criminal prosecution.
(v) where he is undergoing a penalty – no application should be forwarded during the currency of such penalty.
(b) When the conduct of a Government servant is under investigation (by the CBI or by the Controlling Department) but the investigation has not reached the stage of issue of charge-sheet or prosecution sanction or filing of charge-sheet for criminal prosecution in a court, the application of such a Government servant may be forwarded together with brief comments on the nature of allegations and it should also be made clear that in the event of actual selection of the Government servant, he would not be released for taking up the appointment, if by that time any of the situations in (a) above arises.

7. Forwarding of Applications for posts advertised by Central Public Enterprises/ Central Autonomous Bodies:

Applications of Central Government Servants in response to press advertisement for posts in Central Public Enterprises/ Autonomous Bodies may be forwarded with a clear understanding with the employee that in the event of their selection for the post applied for they will sever their connections with the Government before joining the Public Sector Undertakings/ Autonomous Bodies. No lien shall be retained in such cases. The relieving order should indicate the period within which the official should join the Public Sector Undertaking/ Autonomous Body. Normally this period should not be more than 15 days. This period may be extended by the competent authority for reasons beyond the control of the official. Necessary notification/ orders accepting the resignation of the Govt. servant from Govt. service should be issued from the actual date of his/her joining the Public Sector Undertaking/ Autonomous Body. The period between the date of relieving and the date of joining Public Sector Undertaking/ Autonomous Body can be regulated as leave of the kind due and admissible and if no leave is due, by grant of extra ordinary leave. In case he/ she is not able to join the Public Sector Undertaking/ Autonomous Body within the period allowed by the competent authority, he/ she should report back to the parent office forthwith.

Postal Officers Association intend to refer to Association’s lettersdated 23.08.18 and 17-12-2018 (Copy enclosed as Annex- I & II)requesting directorate for causing necessary orders for grant of Non Functional Selection Grade to PS Group ‘B’ officers on completion of four years of regular services as was granted during 6th CPC recommendation and now same has been extended in all cadres.

No such orders have been passed for Group B officers extending the benefit of Non-functional Grade Pay and fixture benefit of higher responsibility on promotion as required under rule FR 22 1(A) 1 to PS Group B officers. Whereas NFSG orders have been granted to all category of employees including AAO but department is silent for Group B officers.

It is therefore requested to kindly intervene and issue orders to extend the benefit of NFSP to all PS Group B officers on completion of four years particularly who joined after 1-1-2012 so that the members of the Association may not feel discriminated.

Your kind attention is invited towards this Associations letter number CHQ/POA/1-22/2017-18 dated 23.08.18 (Copy enclosed as Annex-A) wherein it was requested to issue necessary orders for grant of Non Functional Selection Grade to PS Group ‘B’ officers on completion of four years of regular services as was granted during 6th CPC recommendation and now same has been extended in all cadres. Whereas no such orders have been passed for Group B officers extending the benefit of Non-functional Grade Pay and fixture benefit of higher responsibility on promotion as required under rule FR 22 1(A) 1 to PS Group B officers.  

It is retreated that on the recommendation of 7th CPC, Postal Superintendents (PS Group B officers) of DOP have been given upgraded GP of Rs. 5400/- w.e.f 1.1.2016 without withdrawing benefit of NFGP after four years of service in Group B. Apparently benefit of pay fixation as required under Rule 13 of CCS (Revised Pay Rules) 2016 covered under FR 22 1(a) 1 is required to be bestowed on completion of four years of service at level 10. Unfortunately this benefit of NFSG has not been conferred to PS Group officers on completion of four years of regular service. Merely placement in GP of Rs.5400/- without actual pay fixture is against the fundamental rules in view of Rule 13 of CCS (Revised Pay Rules) 2016. As such, it is clear that PS Group B officer has been given GP of Rs. 5400/-( Level 9) as a replacement to Rs. 4800/- w.e.f 1.1.2016 without withdrawing benefit of NFGP after four years of service in Group B that should be at level 10. 

In this regards attention is also invited towards Ministry of Finance letter No. 26017/219/2016- Ad.II.A dated 10-4-2017 (copy enclosed as Annex-B) wherein it has been clarified to the revenue department that since 7th CPC recommended only normal replacement pay level for Superintendents so NFSG introduced on the basis of 6th CPC recommendation will continue under 7th CPC regime by replacing the pay structure of pay band and Grade Pay with the corresponding Pay Levels/ Cells in Pay Matrix. As such PS Group B officers are also eligible for fixture of pay on completion of four years of service in Group ‘B’ with corresponding pay levels/cells in Pay Matrix. It is pertinent to mention here that NFSG is being allowed in all the cadres as given in the recommendation of 6th CPC. Hence putting PS Group B officers at disadvantageous and detrimental position by not extending the benefit of NFGP is great injustice.

From the foregoing submissions it unambiguously clear that as given in the various GoI notifications PS Group B officers are eligible for grant of non functional up-gradation after four years of regular service in PS Group “B” by replacing the pay structure of Pay Band and grade Pays with corresponding Pay Levels/Cells in Pay Matrix i.e level 10 with all consequential benefits.

Sub.   Issue of orders to grant NFSG to PS Group ‘B’ officers on completion of four years service w.e.f 1-1-2016 as were granted during 6th CPC recommendation.

Respected Sir,

It is to bring to your kind notice that on the recommendation of 7th CPC, Postal Superintendents (PS Group B officers) of DOP have been placed at level 9 in the replacement scale of Rs.5400/- in PB 2 w.e.f. 1-1-2016 which was otherwise given after 4 years of service under 6th CPC with full benefit of pay fixation at that level. Apparently benefit of pay fixation as required under Rule 13 of CCS (Revised Pay Rules) 2016 should also be given to the officers promoted after 1-1-2012 at appropriate level on completion of four years of service. But unfortunately the officers promoted after 1-1-2012 has been debarred from the benefit of NFSG without any logic, reason and rhyme and they have neither given benefit of pay fixation while conferring level 9 on 1-1-2016 nor their pay is being fixed on completion of four years of service.

It is pertinent to mention here that NFSG is being allowed in all the cadres as given in the recommendation of 6th CPC. Hence denying this benefit to PS Group B officers those who promoted after 1-1-2012 is great injustice.
   Furthermore, non grant of NFSG to Group B officer will create big anomaly as direct recruit inspector with entry level 7 will be directly placed at level 10 with maximum of three up-gradations under MACP as such their meaning to promotion at JTS level will cease the purpose. Whereas the promotional hierarchical level of PS Group B is 9 and as such the given pay matrix will restrict the movement of promotes IPs in level 9 under MACP giving no solace of promotion to PS Group B.Therefore, placement grade for the Superintendents should be that of GP 5400/GP2 and after four years GP 5400/PB3 (the improved one), i.e. Level 9 and Level 10.
It is therefore urged to kindly intervene and issue orders to fix the pay of PS Group ‘B’ officers as given in fundamental rules at appropriated level under NFSG on completion of four years particularly who joined after 1-1-2012 so that the members of the Association may not feel discriminated. The officers joined prior to 1-1-2012 have already enjoyed the benefit of fixture of pay under NFSG.
