Parties through their counsel Learned counsel for the petitioners informs that the Punjab and Haryana, Kerala, Allahabad and Jammu and Kashmir High Courts have already granted interim protection to the petitioners/pensioners, wherein, similar kind of provision is the subject matter of challenge. Considering the orders of these Courts in CW.P.No.16320 of 2024, WP(C)No.22753 of 2024 (T), Writ-A No.12596 of 2024 and WP.(C)No.2199 of 2024 respectively, till the next date of hearing, no recovery to be made from the commuted pension of the petitioners without leave of the Court. Counter to be filed within three weeks.List with W.P.No.26042 of 2024 and batch on 11.12.2024 for analogous hearing.It is informed that aggrieved by the similar impugned orders/action, a sizeable number of petitions are being filed by retired Government employees.
Every day, few new similar cases come up against the same orders. Impugned order/action is same in all these matters. In the fitness of things, we deem it proper to pass an order in rem by directing the respondents to extend similar interim protection which is being provided today to all the similarly situated retired State Government employees, whether or not such similarly situated retired State Government employees filed petitions, they shall be entitled for similar interim protection.Copy of this order be provided to learned Government Counsel with request to communicate this order to all the concerned authorities for its strict implementation.
